What is the TN visa?

The TN visa exists thanks to the United States-Mexico-Canada Agreement (USMCA). It allows Mexican professionals to work in the United States in certain professions included on an official list, such as engineers, accountants, architects, nurses, scientists or graphic designers, among others.

  • It has no annual cap.

  • It is granted for periods of up to three years and can be renewed.

  • Mexican professionals apply at the consulate, with an interview.

  • It requires a degree in a listed profession and a job offer in that same profession.

H-1B visa: for specialty occupations

The H-1B visa is for positions that require specialized knowledge and at least a bachelor's degree. The employer files for it, and it has an annual cap assigned through a lottery, so the process is longer and less certain than the TN.

TN or H-1B? Main differences

  • Visa cap: the TN has no cap; the H-1B has an annual cap with a lottery.

  • Professions: the TN only applies to professions on the USMCA list; the H-1B applies to specialty occupations in general.

  • Timing: the TN is usually faster once you have your job offer.

  • Intent: the TN is strictly temporary; the H-1B makes it easier to pursue permanent residency later.

General requirements for the TN visa

  • Valid Mexican passport.

  • University degree in a profession on the USMCA list.

  • Offer letter from a U.S. employer describing the position, duties, duration and salary.

  • Additional documents depending on your profession, such as a professional license or proof of experience.
